Terms and Conditions — “Black Friday DIY Sale November 2025”

These Terms and Conditions (Terms) apply to the “Black Friday DIY Sale November 2025” residential promotion (Promotion).

1. Introduction

1.1 These Terms and Conditions (Terms) govern the Black Friday DIY Sale November 2025 promotion (Promotion).

1.2 The Promotion is offered by Modular Walls Pty Ltd ABN 36 667 192 921 (Promoter, ModularWalls, we, us, our).

1.3 By participating in the Promotion, you (the Customer, you, your) acknowledge and agree that you have read, understood and accepted these Terms.

1.4 These Terms apply in addition to the ModularWalls standard Terms of Sale. To the extent of any inconsistency, these Promotion Terms prevail for purchases made under the Promotion.

2. Eligibility

2.1 The Promotion is open to individuals who:
a) are residents of Australia;
b) are aged 18 years or over; and
c) purchase ModularWalls DIY products directly from ModularWalls for residential use.

2.2 The Promotion is not available to:
a) ModularWalls Trade Partners;
b) employees, directors or contractors of the Promoter;
c) immediate family members of the persons in 2.2(b); or
d) any person or entity purchasing for re-sale or commercial purposes.

2.3 The Promoter reserves the right to require proof of identity, age, and residency, and to verify eligibility prior to accepting any order under the Promotion.

3. Offer Period

3.1 Early Access Period:
Eligible customers who receive a direct email invitation from the Promoter may access the Promotion from 9:00am AEDT on 6 November 2025 until 5:00pm AEDT on 12 November 2025 (Early Access Period).

3.2 General Offer Period:
The Promotion is available to all eligible customers from 9:00am AEDT on 12 November 2025 until 5:00pm AEDT on 28 November 2025 (Offer Period).

3.3 All times and dates refer to Australian Eastern Daylight Time (AEDT).

3.4 The Promoter reserves the right to to verify eligibility and to amend or withdraw this offer at its discretion without prior notice.

4. Promotional Offer

4.1 During the Offer Period, eligible customers will receive a 15% discount off the Recommended Retail Price (RRP) of ModularWalls DIY materials (Base Discount).

4.2 An additional discount of two and a half percent (2.5%) off the RRP of ModularWalls DIY materials (Bonus Discount) will only apply where a single order with a total recommended retail price (RRP) of ten thousand dollars ($10,000) or greater is placed under one (1) order number.

4.3 The maximum discount available under the Promotion is 17.5% off DIY materials (RRP) only. The Bonus Discount cannot be applied to multiple orders, split orders, or combined orders.

4.4 The Promotional discount(s):
a) apply to DIY materials only;
b) do not apply to freight, GST, gates, customisations, AcoustiSorb, TerraFirm Pro, X or XL products, installation services, or any non-material items.

4.5 The Promotion is valid for one (1) customer per transaction and must not be transferred, shared, or combined with any other customer, order, or promotion. ModularWalls reserves the right to verify eligibility and to amend or withdraw this offer at its discretion without prior notice.

4.6 The Promotion cannot be used in conjunction with any other offer, promotion, code, discount or incentive, unless expressly authorised in writing by the Promoter.

5. Payment, Dispatch and Collection

5.1 Full payment for orders under this Promotion must be received by the Promoter no later than 12:00pm AEDT on 28 November 2025.

5.2 Orders must be collected (or delivery accepted, if applicable) no later than 12:00pm AEDT on 19 December 2025.

5.3 If payment and/or collection is not completed by the deadline in clause 5.2, the Promoter may cancel the order and issue a refund less a 25% restocking fee.

5.4  It may take up to five (5) business days from order to dispatch, while shipments to Western Australia and remote areas may take longer than five (5) business days. Customers acknowledge deliveries may require additional time.

6. Fraud, Misuse and Compliance

6.1 The Promoter reserves the right to refuse, cancel, or amend any order that:
a) does not comply with these Terms;
b) is suspected to be fraudulent or ineligible; or
c) involves misuse or manipulation of the Promotion.

6.2 The Promoter may require additional documentation or verification before fulfilling any order under this Promotion.

7. Liability and Australian Consumer Law

7.1 Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other legislation that cannot be excluded by law.

7.2 To the maximum extent permitted by law, the Promoter is not liable for:
a) any loss, damage, claim or expense suffered as a result of the Promotion, except to the extent caused by the Promoter’s negligence;
b) any failure or delay caused by events outside its reasonable control.

7.3 The Promoter’s liability for breach of any non-excludable guarantee is limited, at the Promoter’s option, to the replacement of goods, supply of equivalent goods, or refund.

8. Privacy

8.1 Personal information collected in connection with the Promotion will be handled in accordance with the Promoter’s Privacy Policy, available at www.modularwalls.com.au/privacy-policy.

8.2 By participating in the Promotion, you consent to the Promoter using your personal information for purposes related to the Promotion and to communicate with you about ModularWalls products and services (unless you opt out).

9. Governing Law

9.1 These Terms are governed by the laws of New South Wales, Australia.

9.2 Each party submits to the non-exclusive jurisdiction of the courts of New South Wales.
